DEA registration

Required for any practitioner who prescribes / handles / dispenses controlled substances. Renewable every 3 years. Per-state — if you locum across states, separate DEA per state of practice. Federal MATE Act 2023 added 8-hour SUD training as one-time requirement attached to DEA renewal. Valid registration must list correct practice address + state license number.

Documentation requirements

Every controlled substance order/prescription requires: patient identification, indication, drug + strength + quantity, refills (typically 0 for schedule II), date, prescriber signature/PIN. Records retained per state law (typically 5-7 years; CA requires 7). EHR audit logs tracked. Clinical justification for each opioid prescription documented in note.

Telehealth + Ryan Haight Act

Ryan Haight Online Pharmacy Act 2008 requires in-person evaluation before prescribing controlled substances via telehealth — UNLESS exception applies. COVID-era public health emergency suspended this; current rules as of 2024 DEA proposed final rule: telehealth-only initial schedule III-V allowed for 30 days, then in-person required; schedule II generally requires in-person. Buprenorphine has special exception (audio + video sufficient for initial). Check current DEA guidance.

Audit + investigation triggers

Top triggers: PDMP outliers (high prescribing volume vs peers), patient overdose deaths linked to your prescribing, pharmacist reports, patient complaints, state-board renewal red flags. Maintain: clean PDMP queries + documentation, conservative + justified prescribing, response plan if contacted (engage attorney IMMEDIATELY before answering questions). Self-audit annually.
